Welcome to Special Needs Care Network ("SPCN," "we," "our," or "us"). By using our website specialneedsusa.com ("Site"), you agree to the following Terms of Service. If you do not agree, please discontinue use immediately.

1. Purpose of the Site

SPCN is an online directory designed to connect families, caregivers, and individuals with schools, service providers, and resources related to special needs education and care. The information provided is for informational purposes only and is not medical, legal, or professional advice.

2. No Endorsement or Guarantee

Listings on our Site do not imply endorsement, recommendation, or guarantee. We do not verify every detail provided by third parties and cannot be held responsible for inaccuracies. Users are encouraged to independently verify any information before making decisions.

3. User Accounts & Submissions

If you create an account (e.g., to claim a listing) or submit content (such as reviews, lead forms, or provider information), you agree to provide accurate and lawful information.

• You are responsible for maintaining the security of your account.
• By submitting content, you grant SPCN a non-exclusive, royalty-free license to display and distribute it on our Site.
• Reviews are subject to moderation. We may reject or remove reviews that we determine to be false, abusive, or otherwise in violation of these Terms.

4. Provider Relationships & Lead Submission

We may have paid relationships with certain providers. Some listings are marked as "Sponsored" to indicate that a provider pays for enhanced visibility. Sponsorship does not constitute a recommendation or endorsement. When you submit a lead or use a matching service, we may present you with a list of providers that appear to match your needs. You choose which providers, if any, may receive your information and contact you. Contact may include phone, text message, and email. Providers are responsible for honoring any request from you to stop contact.

5. Sponsored Listings & Advertising

Some listings or features may be sponsored or paid placements. These will be clearly identified as such.

6. Prohibited Conduct

You may not use the Site to:

• Submit false, misleading, or fraudulent information
• Scrape, harvest, or use automated means to collect data from the Site without permission
• Spam, harass, or misuse the contact or lead submission features
• Violate any applicable law or the rights of others

We may suspend or terminate access for violation of these terms.

7. Limitation of Liability

To the maximum extent permitted by law, SPCN and its officers, directors, and affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your use of the Site, including reliance on information found here, how listings are ranked or displayed, or actions of any third-party providers. Your sole remedy for dissatisfaction is to stop using the Site.

8. Modifications

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. Material changes may be noted by an updated effective date; we encourage you to review these Terms periodically.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Site shall be brought in the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction and venue in those courts.

10. Paid Provider Listings

10.1 Fees & Billing. Paid listings are offered on a subscription basis. The fee, billing interval, and subscription term applicable to your listing are those set forth in the order form, invoice, or provider agreement you accept at the time of purchase. Rates are not published here and may vary by market and tier. Fees are charged for advertising placement only. They are not charged per inquiry, per family, per referral, or per enrollment.

10.2 Approval. All paid listings are subject to review and approval by SPCN. If your application is not approved, you will receive a full refund. Approval is not guaranteed.

10.3 Cancellation & Refunds. Cancellation rights, notice periods, and any refund or proration terms are those set forth in your provider agreement. If your application is not approved and your listing never goes live, you receive a full refund as described in 10.2.

10.4 Term & Renewal. Your subscription term and renewal terms are those set forth in your provider agreement.

10.5 Removal. SPCN reserves the right to suspend or remove any listing that violates these Terms, contains inaccurate or misleading information, or no longer meets our verification standards. Removals for policy violations are not eligible for a refund.

10.6 Limited Placement Slots. Some tiers include top placement slots that are limited in number within a given city or metro area. The number of slots available in your market, and the terms for claiming or waitlisting one, are set forth in your provider agreement. If your market is at capacity, all other benefits of your tier remain active during any waitlist period.

10.7 No Guarantee of Results. Paid listings increase visibility on the SPCN platform. SPCN does not guarantee a specific number of inquiries, leads, or enrollments. Because fees are for placement rather than for results, no portion of any fee is contingent on the volume or outcome of family contacts.
